We have added into the toolkit – Time to Train documentation, this is important as Employees have the right to ask for time off work for training and development. Employees can ask for time off to train if, they are classed as an employee of the company, they have worked for their employer for at least 26 weeks, the training will help the employee do better at their job and at least 250 people must work in the organisation.

Invitation to Time to Train Appeal Meeting

An Employee who is employed in an organisation with 250 or more Employees and who has at least 26 weeks’ continuous service has the legal right to make a request in relation to study or training and to have their request considered.

Where an Employee’s statutory request for study or training is declined, the Employee has a statutory right to lodge an appeal against the decision within 14 days of the refusal.

The Employer must hear the appeal within another 14 days and communicate the outcome in writing to the Employee within a further 14 days.

This template letter can be used to invite the Employee to attend an appeal meeting.

An Employee who is employed in an organisation with 250 or more Employees and who has at least 26 weeks’ continuous service has the statutory right to make a request in relation to study or training and to have their request considered.

Where the Employer decides to agree to the Employee’s request and writes to the Employee to confirm their agreement within 28 days of the request, no further procedure is required.

Otherwise, the Employer is under a statutory duty to hold a meeting with the Employee to discuss the request within 28 days of receiving the request.

This template letter can be used where the Employer agrees to the training request.

An Employee who is employed in an organisation with 250 or more Employees and who has at least 26 weeks’ continuous service has the statutory right to make a request in relation to study or training and to have their request considered.

This document is an application form for an Employee to use to submit an application to train.

You can use this policy and procedure to add to your existing Employee Handbook or a standalone policy and Procedure, it can be used where an Employee has a continuous period of 26 weeks of employment, they have a statutory right to request time off for study or training and to have that request considered by the Employer.

Undertaking to Repay Costs Incurred During External Training Courses

This Agreement must be signed by both parties prior to commencement of the Course.

When enforcing the right conferred by this agreement an employer should ensure that in cases of redundancy or ill health dismissal, the final pay must remain above the NMW.
